Terms of Business of Midwood Heating
For these Terms of Business (the “Terms”), “us” or “we” means Midwood Heating, and “you” means our customer. By asking us to perform certain works, you agree to these Terms.
1. Estimate
The estimate shows what we expect to charge you based on our talks. If unforeseen issues arise, we may need to adjust the price and provide a new estimate. You can choose to accept or decline the revised price.
2. Written Quotation
The written quotation follows the estimate and is the final price for the agreed works. This includes labour, materials, any additional costs, and tax. If the scope changes or unforeseen issues arise, we may issue a new quotation. You can accept or decline this new quotation. If you decline, all work will stop. You must pay for any completed works as per the original quotation.
3. Client Obligations
(i) If you agree to provide measurements for materials or products, you will cover costs for replacing any that are incorrect.
(ii) If you provide materials or products and they are faulty or unsuitable, you will pay for replacements.
(iii) You will inform us of any known or suspected hazards at the work site before we start.
(iv) You will give us access to the work site and ensure all necessary permissions are obtained before we begin.
(v) You will securely store any materials or equipment left at the site. You are responsible for any loss or damage.
(vi) Unless included in the quotation, you will handle any necessary improvements or redecorating after the works are complete.
4. Supplier Obligations
(i) We will perform the works with care and skill, aiming to finish in a reasonable timeframe and comply with all laws.
(ii) We will supply high-quality materials and will replace any that are faulty or substandard.
(iii) We will take care of your property and remove any waste from the site after completing the works.
(iv) We will provide one or more team members for the works. We choose who will come, and they might not be the same people who gave you the original estimate or quotation.
(v) We confirm that we hold a valid Public Liability Insurance Policy and, if relevant, an Employers Liability Insurance Policy.
5. Materials and Products
All materials and products supplied to you remain the property of Midwood Heating until you pay in full. Ownership transfers to you only after full payment is received.
6. Force Majeure
Neither party is liable for delays or failures due to circumstances beyond their control. This includes events like natural disasters, fire, government actions, and supply issues.
7. Cancellation
You may cancel the contract within fourteen (14) days of accepting our quotation, as per the Consumer Contract Regulations 2013. You must pay for any services received during this cancellation period.
8. Payments
Payment terms are outlined in the applicable quotation. You agree to pay any undisputed invoice within 7 days of receipt. If you miss a payment, you agree to pay interest at 5% above the Bank of England base rate.
9. Complaints
We hope you won’t have any issues with our service. If something doesn’t meet your expectations, please let us know, and we will do our best to resolve it.
